DATA PROTECTION CLAUSE

Health in Code S.L. complies with the provisions on data protection, and by virtue of Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”) and of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April, the personal data collected on the website will be treated in accordance with this legislation and incorporated into a file for which Health in Code S.L. is responsible.

The fields marked with an asterisk (*) are mandatory and indispensable to perform the required service. The purpose of the processing is the management of users for the access and use the software “Computerized Register of Hereditary Hemorrhagic Telangiectasia (RiHHTa)” - https://rihhta.healthincode.com - ,for which the categories of data related to the identification of the person will be collected, including the name, contact email, group and work center.

The processing carried out is used exclusively for the purposes established above and collects only data necessary to this end. The data is provided by the interested party and its use authorized by a consent that is expressly granted by accepting these conditions. This consent can be withdrawn at any time.

Said data will not be transferred to third parties without a corresponding prior consent, or in cases other than those expressly defined in data protection legislation.

We also inform you that your data will be kept for the duration of the relationship established with the entity or until you exercise your rights of withdrawal or erasure. In the case of a mere consultation, your data will be kept for a minimum of 5 years from the last notification.

You can exercise the rights of access, rectification, cancellation or deletion, opposition, restriction to processing, and portability of your data by contacting us at: Ed. TERMS OF USE LOPDGDD

By accepting these conditions, you also agree to maintain the registry as a system that maintains anonymous patient data for research use. In no case will any identifying data of the patients be stored in any of the software fields, such as names and surnames, identification documents numbers (DNI, Passports, Social Security Number, etc.)

On the other hand, you agree to have all the permits, guarantees and authorizations (if necessary or required) of your work center for the use of the Registry.

If the User intentionally fails to fulfill any of the previously stated obligations, he/she will be liable for any damages that may consequently be caused to HEALTH IN CODE de or a third party.

2. Responsability of Health in Code

HEALTH IN CODE reserves the right to make changes to the Website and to these General Terms and Conditions.

In addition, given the special nature of the medium chosen to communicate with Users, HEALTH IN CODE cannot assume responsibility for the:

a) Temporary inability to access the Website at a particular time, or specific information included in HEALTH IN CODE or in other Websites the User may access through hypertext links on the Website.

Under no circumstances will HEALTH IN CODE grant any license nor will it renounce, transfer, partially or totally assign said property rights, especially those allowing the exploitation, reproduction, distribution, transformation or public communication of said Content without previous express written authorization by HEALTH IN CODE (regarding the design of the Website or the use of the trade name “HEALTH IN CODE”) or by the corresponding third parties.

Violations of any of the intellectual or industrial property rights to which this section refers will be prosecuted by the criminal and civil actions included in the legislation in force.

4. Jurisdiction

Any litigation or dispute that may arise between HEALTH IN CODE and a User about the interpretation or the application of these General Terms and Conditions or directly or indirectly related to the use of the services offered by this Website, will be resolved by the Courts in A Coruña (Spain).

As a requirement prior to litigation, HEALTH IN CODE and the User agree to negotiate in good faith with the aim of resolving the litigation or dispute for a period of one (1) month as from the date on which one of the parties notifies the other in writing of its intention to potentially start litigation.

Any communication that is necessary between HEALTH IN CODE and the User should be sent to the address listed in HEALTH IN CODE by any of the various means of communication (registered mail or e-mail) that are listed at beginning of this clause.

HEALTH IN CODE will communicate with the User by contacting her/him through the contact details provided by the User when registering with the Website, or through the contact details provided in the first communication sent by the User.
